Welcome to TourGrids. By using our website, mobile application, or any of our services (collectively, the "Platform"), you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully.

Use of Platform

Eligibility: You must be at least 18 years of age or the age of legal majority in your jurisdiction to access and use the Platform. By using TourGrids, you represent and warrant that you meet these requirements.
Account Creation: In order to access certain features, such as submitting travel inquiries or saving packages, you may be required to create an account. You agree to provide accurate, complete, and updated information during registration.
Account Security: You are responsible for safeguarding your login credentials. TourGrids will not be liable for any unauthorized access or actions taken under your account if your credentials are compromised.
Permitted Use: The Platform is intended solely for personal, non-commercial use unless otherwise agreed upon in writing with TourGrids. You may not use the Platform for commercial travel agency operations, data scraping, resale of services, or bulk lead generation.
Prohibited Conduct: You agree not to:
- Upload or transmit any viruses, malware, or harmful code.
- Use automated scripts or bots to access, collect, or manipulate data on the Platform.
- Infringe upon or violate the intellectual property rights or privacy rights of TourGrids or third parties.
- Post misleading, false, defamatory, or abusive content or messages.
- Interfere with the performance or security of the Platform, including attempting unauthorized access to systems or data.
Termination Rights: TourGrids reserves the right to suspend or terminate your access to the Platform at any time, with or without notice, for any conduct that violates these Terms or is deemed harmful to our operations, reputation, partners, or users.
Service Availability: We strive to keep the Platform available at all times but do not guarantee uninterrupted access. Scheduled maintenance, updates, or unexpected outages may limit access without prior notice.

Aggregated Travel Listings

Aggregator Role: TourGrids is a travel aggregator platform that collects, organizes, and presents travel packages, deals, and services from multiple third-party travel providers. We do not own, operate, or manage any of the tours, accommodations, transport services, or experiences listed on the Platform.
Information Sourcing: All listings, prices, availability, itineraries, and other package details are provided directly by third-party partners or sourced from publicly available information with permission. TourGrids does not independently verify every detail and cannot guarantee its real-time accuracy.
Non-Endorsement: The inclusion of a travel provider or package on our Platform does not constitute an endorsement or guarantee of quality, safety, or reliability. Users are encouraged to conduct their own due diligence before booking.
Dynamic Listings: The availability, pricing, and descriptions of travel packages may change frequently. TourGrids updates its listings regularly but cannot be held responsible for discrepancies caused by delays or changes from the travel provider.
Provider Verification: While TourGrids makes efforts to onboard and display listings from reliable travel partners, we do not perform on-site inspections or full operational audits. TourGrids does not take responsibility for false claims made by the providers.
Booking Redirection: In many cases, users will be redirected to the third-party provider's own platform, form, or communication channel for inquiry or booking. Once redirected, you are subject to the terms and conditions of that specific provider.
Partner Conduct: Each travel provider is independently responsible for the quality, safety, legal compliance, and delivery of their travel services. TourGrids will not be held liable for service delays, cancellations, misrepresentations, or disputes that occur between users and partners.
Service Filtering: TourGrids reserves the right to remove, hide, or deprioritize any listing or provider that fails to meet quality standards, violates our policies, or receives repeated complaints, without prior notice.
Feedback Loop: Users are encouraged to leave honest feedback about their experience with listed providers. This helps maintain transparency and improve service quality across the Platform.

Booking and Payments

Third-Party Bookings: TourGrids operates as a travel aggregator and does not directly provide travel services such as hotel bookings, transportation, or tour operations. All bookings are made through third-party travel providers listed on our Platform.
Facilitation Role: TourGrids acts solely as an intermediary by displaying travel packages, deals, and services offered by verified partners. We assist with the initial communication and sometimes the booking interface, but the final transaction is executed by the third-party provider.
Accuracy of Listings: While we strive to ensure all listings and prices are up to date, TourGrids does not guarantee the accuracy, availability, or completeness of any travel offer. Prices, availability, and package features are subject to change without notice and are controlled by the service provider.
Payment Terms: Some bookings may require direct payment through the travel provider, while others may be routed through TourGrid's payment gateway (if applicable). You agree to abide by the payment terms specified at the time of booking.
Currency and Charges: All prices listed are generally in Indian Rupees (INR) unless stated otherwise. Additional fees, foreign currency charges, and taxes may be applicable depending on your payment method and provider policies.
Confirmation of Booking: Your booking is not confirmed until you receive a formal confirmation email or message from the third-party provider. TourGrids is not responsible for any losses incurred due to delayed or failed confirmations.
Payment Disputes: Any dispute related to payments, failed transactions, overcharging, or billing issues must be directed to the respective travel provider or payment processor. TourGrids will provide necessary assistance but does not hold financial liability for such disputes.
Fraud Prevention: TourGrids reserves the right to decline or cancel bookings that are flagged as suspicious, unauthorized, or potentially fraudulent. We may require identity verification before processing certain payments or inquiries.

Cancellation and Refund Policy

Third-Party Policies Apply: Since TourGrids is a travel aggregator, all cancellations, modifications, and refund requests are governed by the policies of the respective third-party travel providers. These may vary from provider to provider.
User Responsibility: It is your sole responsibility to review and understand the cancellation, rescheduling, and refund terms of a provider before confirming any booking through our Platform.
Initiating a Cancellation: You must initiate cancellation requests directly with the travel provider or through the contact method provided at the time of booking. If TourGrids has facilitated the booking interface, we may help forward your request but are not responsible for the outcome.
Refund Timelines: Refund timelines vary depending on the provider's internal processing and payment channels. TourGrids does not control or expedite refunds but can assist in tracking the request where possible.
Non-Refundable Bookings: Some bookings, such as discounted or promotional packages, may be non-refundable or may carry heavy cancellation penalties. These conditions will typically be mentioned at the time of booking.
Partial Refunds: If a partial refund is allowed, it will be calculated based on the provider's refund policy, minus any applicable service fees, taxes, or cancellation charges.
Force Majeure: Refunds may not be available in cases of force majeure events (such as natural disasters, war, pandemic-related restrictions, or government actions) unless explicitly stated in the provider's terms.
Platform Fees: Any booking or service fee charged by TourGrids (if applicable) may be non-refundable, even if the provider issues a full or partial refund.
TourGrids Support: While TourGrids is not liable for refunds, we strive to mediate between you and the provider when disputes arise. However, we cannot guarantee resolutions or enforce provider commitments.

User Responsibilities

Accuracy of Information: You agree to provide accurate, complete, and up-to-date information when registering on the Platform, submitting inquiries, or interacting with travel providers. Any false, misleading, or outdated information may lead to the suspension or termination of your access.
Account Security: You are responsible for maintaining the confidentiality of your TourGrids account credentials. You must promptly notify us of any unauthorized use or security breach related to your account.
Lawful Use: You agree to use the Platform only for lawful purposes and in accordance with all applicable laws, regulations, and third-party agreements. You may not use the Platform to promote or engage in any illegal, abusive, or fraudulent activities.
Respectful Conduct: When interacting with travel providers, TourGrids support staff, or other users, you agree to maintain a respectful, non-abusive tone. Harassment, threats, discriminatory language, or spamming will not be tolerated.
Use of Content: You must not copy, download, modify, distribute, or publicly display any content on the Platform without express written permission from TourGrids or the relevant copyright holder.
Reviews and Feedback: If you choose to submit reviews, testimonials, or ratings, you agree to provide honest, factual, and respectful content. TourGrids reserves the right to remove any review that is false, offensive, or manipulative.
Device Compatibility: You are responsible for ensuring that your devices and internet connection are compatible with our Platform. TourGrids is not responsible for any limitations due to device incompatibility or connectivity issues.
Third-Party Interactions: Any agreements, transactions, or disputes between you and third-party travel providers are your sole responsibility. TourGrids does not represent either party and is not liable for service failures or contractual disagreements.
Indemnification: You agree to indemnify and hold harmless TourGrids, its affiliates, and partners from any claims, damages, losses, or liabilities arising from your misuse of the Platform, violation of these Terms, or breach of third-party rights.

Intellectual Property

Ownership: All content and materials available on the TourGrids Platform—including but not limited to text, images, videos, graphics, logos, icons, user interface elements, software code, and design layouts—are the exclusive property of TourGrids or its content suppliers and are protected under applicable intellectual property laws, including copyright, trademark, and trade secret laws.
Limited License: TourGrids grants you a limited, non-transferable, non-exclusive, revocable license to access and use the Platform solely for personal and non-commercial purposes, in accordance with these Terms and Conditions. No other rights are granted by implication or otherwise.
Prohibited Uses: You may not:
- Copy, reproduce, modify, or create derivative works from any content on the Platform.
- Distribute, transmit, display, or perform any Platform content without prior written permission.
- Reverse-engineer, decompile, or attempt to extract the source code of any part of the Platform.
- Use our trademarks, branding, or logos without our explicit consent.
User Content: By submitting or uploading any content (e.g., reviews, photos, or feedback) to the Platform, you grant TourGrids a worldwide, royalty-free, perpetual, non-exclusive license to use, display, reproduce, and distribute such content in connection with the operation and promotion of the Platform. You represent that you have the right to grant such a license and that your content does not violate any third-party rights.
Trademarks: "TourGrids" and all related names, logos, and design marks are trademarks or registered trademarks of TourGrids or its licensors. Unauthorized use of these marks is strictly prohibited and may result in legal action.
Third-Party Content: Some content on the Platform may be owned by or licensed from third-party providers (e.g., travel operators, image libraries, APIs). Such content remains the property of its respective owners and is used under license. You may not reuse or redistribute such content without appropriate authorization.
Violation Consequences: Any unauthorized use of TourGrid's intellectual property may result in suspension of access, termination of services, and potential legal proceedings under applicable laws.

Disclaimer of Warranties

Platform Provided "As Is": The TourGrids Platform, including all content, features, and services, is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise.
No Guarantee of Accuracy: While we aim to display accurate and up-to-date travel information, we do not guarantee the completeness, accuracy, reliability, or availability of any listings, prices, descriptions, or content made available through the Platform.
Third-Party Services: TourGrids does not warrant or endorse the quality, safety, legality, or suitability of third-party travel services or providers listed on the Platform. All travel arrangements are made at your own discretion and risk.
No Warranty of Availability: We do not guarantee that the Platform will be uninterrupted, secure, or error-free. There may be temporary downtimes due to maintenance, technical issues, or external factors beyond our control.
Virus and Security Disclaimer: While we take reasonable steps to protect the Platform, we do not warrant that the Platform will be free from viruses, malware, or other harmful components. You are responsible for using appropriate security and antivirus software on your devices.
Third-Party Content: TourGrids is not responsible for any third-party content, links, advertisements, or promotions accessible through the Platform. We make no warranty regarding the accuracy or reliability of such third-party materials.
No Implied Warranties: To the fullest extent permitted under applicable law, we disclaim all implied warranties, including but not limited to merchantability, fitness for a particular purpose, title, and non-infringement.
User Reliance: Any reliance you place on the information or services found on the Platform is strictly at your own risk. TourGrids is not liable for decisions made based on Platform content or provider offerings.

Limitation of Liability

No Liability for Third-Party Services: TourGrids serves solely as an aggregator and does not control or operate the tours, accommodations, transport, or other services offered by third-party travel providers. We are not liable for any acts, errors, omissions, or negligence of these providers.
Indirect Damages: To the fullest extent permitted by law, TourGrids shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, goodwill, data, or other intangible losses, resulting from your use or inability to use the Platform or any travel services booked through it.
Service Interruptions: We are not responsible for any disruptions, delays, failures, or damages caused by technical issues, server downtime, maintenance activities, or force majeure events such as natural disasters, strikes, or internet outages.
User-Generated Content: TourGrids assumes no responsibility or liability for any content posted, uploaded, or shared by users or third parties on the Platform. This includes reviews, ratings, comments, or feedback that may be inaccurate, offensive, or misleading.
Booking Disputes: Any disputes, losses, cancellations, or dissatisfaction arising from bookings, changes, or travel experiences are solely between you and the travel provider. TourGrids does not participate in nor accept liability for resolving such matters.
Limitation of Total Liability: In any event, TourGrid's total aggregate liability for any claim related to your use of the Platform shall not exceed the total amount (if any) paid by you to TourGrids in connection with the service giving rise to the claim, or INR 1,000—whichever is lower.
Jurisdictional Exceptions: Some jurisdictions do not allow the exclusion or limitation of certain types of damages. In such cases, the above limitations may not fully apply to you, but will apply to the maximum extent permitted by law.

Modifications to Terms

Right to Modify: TourGrids reserves the right to change, modify, revise, or update these Terms and Conditions at any time, at its sole discretion, without prior notice to users.
Notification of Changes: Any updates to the Terms will be reflected with a revised "Last Updated" date at the top of the page. In some cases, we may also notify users via email or through a Platform alert.
User Responsibility: It is your responsibility to review these Terms periodically to stay informed of any updates. Continued use of the Platform following any changes constitutes your acceptance of the revised Terms.
Material Changes: If we make significant changes that affect your rights or obligations, we will attempt to provide clear notice. However, failure to receive such notice does not invalidate the enforceability of the updated Terms.
Disagreement with Terms: If you do not agree with the updated Terms and Conditions, you should discontinue use of the Platform immediately and, if applicable, request closure of your account.

Governing Law

Jurisdiction: These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law provisions.
Legal Venue: Any disputes, claims, or controversies arising out of or in connection with your use of the Platform or these Terms shall be subject to the exclusive jurisdiction of the courts located in Rajasthan, India.
Compliance with Local Laws: While the Platform is accessible globally, you are responsible for ensuring that your use of TourGrids complies with all local laws and regulations applicable in your jurisdiction.
Cross-Border Use: If you access or use the Platform from outside India, you do so at your own risk and remain solely responsible for compliance with local laws, including export and import regulations.
No Waiver of Rights: Any failure by TourGrids to enforce any provision of these Terms shall not constitute a waiver of our rights to enforce that or any other provision at a later time.
